Fleeing & Eluding Cases: Oklahoma City, OK: Martino Law FirmMost of us have been pulled over by the police in our lives. The "flashing red & blue" is enough to make any law abiding citizen nervous, regardless of the circumstances. Sometimes when we are driving though, we are faced with many different distractions (kids, radio, directions from a gps, etc.) and we just don't see those lights or hear that siren. Unfortunately, most police officers aren't going to buy those excuses, no matter how rational and reasonable they are.
Under OKkahoma law, attempting to flee or elude the police is a criminal offense. If a police officer activates his emergency lights and/or siren in an attempt to pull your vehicle over, you are required to stop. If you don't stop, and the State can prove that you "wilfully" attempted to elude the police, you could be guilty of a misdemeanor and face up to 1 year in jail and/or a $5000.00 fine. If you happen to endanger the safety of other motorists or cause an accident while attempting to elude the polic, you could be guilty of a felony and face 1-5 years in prison and/or a $5000.00 fine.
I can help you explain your side of the story to the DA, the Judge and the Jury. I can help convince them that you did not "wilfully" elude the police and because of that, you should be found not guilty.
